1. Acceptance of Terms & Eligibility
Welcome to Crypto Trade. These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the Crypto Trade platform, web applications, mobile services, and related trading functionalities.
By registering an account, verifying your identity, or initiating any transaction on Crypto Trade, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
- You must be at least 18 years of age (or the age of legal majority in your jurisdiction).
- You must possess full legal capacity to enter into binding agreements.
- You confirm that you are not a resident of any restricted or sanctioned jurisdictions and are not listed on any government financial watchlists or anti-money laundering sanctions.
2. Account Registration & Mandatory KYC
To access cryptocurrency trading services, users must register an account and complete our multi-tier identity verification procedures in compliance with the Prevention of Money Laundering Act (PMLA) and regulatory standards:
- Identity Documentation: Users must submit authentic government-issued identity documents, including Aadhaar (via DigiLocker/UIDAI OTP) and permanent account number (PAN).
- Liveness & Biometrics: Real-time face match and liveness checks may be required to verify proof of life and eliminate identity fraud.
- Accuracy of Information: You agree to provide true, accurate, and current information. Providing forged, altered, or third-party documents is strictly prohibited and results in immediate account termination and regulatory reporting.
- Bank Account Verification: All fiat INR bank accounts or UPI identifiers linked for deposits and payouts must strictly match the legal name verified on your KYC profile.
3. P2P Order Execution & Escrow Protection
Crypto Trade facilitates peer-to-peer (P2P) digital asset trading where buyers and sellers exchange cryptocurrency for fiat currency directly with platform escrow protection:
- Escrow Mechanism: When a trade order is initiated, the designated cryptocurrency amount is securely locked in platform escrow until the trade is completed or formally cancelled.
- Fiat Payment Obligations: Buyers must transfer the exact agreed fiat amount directly to the seller's verified bank account or UPI ID and upload proof of payment in the dedicated order chat.
- No Third-Party Payments: Payments sent from bank accounts, UPI IDs, or wallets belonging to third parties other than the registered account owner are strictly rejected.
- Cryptocurrency Release: Sellers are obligated to verify receipt of cleared funds in their personal bank account before confirming release of escrowed digital assets.
- Dispute Resolution: If a discrepancy arises regarding payment confirmation or transfer status, either party may raise a dispute. Platform moderators will review chat logs, payment receipts, and bank statements to make a binding settlement decision.
4. Risk Disclosure & Blockchain Irreversibility
Cryptocurrency transactions involve inherent technological and market risks:
- Price Fluctuations: Digital asset values are subject to rapid market changes without prior notice. Crypto Trade does not guarantee asset value or offer investment advice.
- Blockchain Irreversibility: Blockchain transfers (e.g., USDT TRC-20, ERC-20, BTC, ETH) are irreversible once broadcast to the network. Crypto Trade is not responsible for funds sent to incorrect, unsupported, or incompatible blockchain addresses.
- System & Network Delays: Periodic network congestion or blockchain forks may cause temporary delays in transaction confirmation.
5. Fees, Pricing & Tax Adherence
Crypto Trade displays transparent exchange rates and fees before order confirmation:
- Trading & Platform Fees: Applicable trading spreads, maker/taker commissions, and withdrawal network fees are clearly disclosed in the order review interface.
- Taxation (TDS / Income Tax): Users are solely responsible for calculating and paying all applicable local, state, and national taxes, including Tax Deducted at Source (TDS under Section 194S) and capital gains taxes arising from virtual digital asset transactions.
6. Prohibited Activities & Zero-Tolerance Violations
Users must strictly refrain from any unauthorized or unlawful activity. Prohibited conduct includes:
- Using the platform for money laundering, terrorism financing, or illicit drug trafficking.
- Engaging in market manipulation, wash trading, or unauthorized automated scraping.
- Conducting fraudulent chargebacks, payment recalls, or submitting fabricated transaction slips.
- Operating mule accounts or permitting third parties to execute trades through your registered profile.
- Interfering with platform security, reverse-engineering code, or attempting unauthorized system access.
7. Account Security & Protection
You are responsible for maintaining the confidentiality and control of your login credentials, mobile phone OTPs, and API keys:
- Never share OTP codes, passwords, or recovery tokens with anyone, including individuals claiming to be Crypto Trade support staff.
- Immediately notify our security desk if you suspect unauthorized access or compromise of your account.
- Crypto Trade will not be liable for losses resulting from user-side credential leakage or social engineering scams.
8. Termination, Dispute Resolution & Governing Law
Crypto Trade reserves the right to suspend, restrict, or terminate account access and withhold pending orders if suspicious activity, terms violations, or law enforcement notices are received.
These Terms shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts.
